Who can go on strike?

Everyone. Whether you work in an office, a restaurant, a café, a laboratory, or a theatre. All workers, from all sectors, with any type of employment relationship—whether unionised or not—have the right to strike. It's in the law, and in the most important law of all: the Constitution.

Do I have to notify my boss?

No. Workers, whether in the public or private sector, are not obligated to notify their boss that they will be going on strike. And importantly: even if the boss asks.

Does this apply to teleworking?

Yes. All workers, regardless of how they perform their work, have the right to strike.

How does my boss know if I'm absent due to a strike or for another reason?

Unless you provide another justification, your boss will assume you have joined the strike. If you are teleworking, do not log in to the server/programme and/or do not respond to the tasks you were supposed to have on that day.

Is the day paid?

No. The strike suspends the contract for that day, which means there is no pay. But it also doesn't count as an unjustified absence.

What about the attendance bonus? Is it lost?

Also, no! Absence due to a strike does not affect the attendance bonus, seniority, or length of service.

I work shifts, and on that day I'm working the night shift. What do I do? From the 2nd to the 3rd or from the 3rd to the 4th?

If you work shifts and at night, the strike starts from the 2nd to the 3rd, on the shift that covers midnight from the 2nd to the 3rd.

I have children and no one to leave them with; the school will be closed. Will I be penalised?

Yes, if you join the strike.

Can I join a strike called by another union?

Yes. As long as it covers your sector or company. In the case of the CGTP-IN's advance notice for the General Strike, the coverage is general.

Do I have to justify my absence later?

No. Those who go on strike don't need to justify anything.

Picket lines: who organises them?

They are organised by unions and may include company workers or union representatives.

What can picket lines do?

They can attempt to persuade, inform, and mobilise through peaceful means, without preventing from working those who do not participate.

Can the employer prohibit, pressure, or punish someone for striking?

No. It is illegal to coerce, harm, or discriminate against any worker for participating in a strike. The law provides for heavy fines for this type of practice, which should be reported immediately.

Can picket lines be inside the company premises?

Yes, as long as they do not impede the freedom of work of others.

Can they replace me? What if the boss puts someone in my place with the excuse that they didn't know I was on strike? What do I do?

No. Replacing a striking worker is a crime. Another person cannot fill a striking worker’s job. If you know that your job has been replaced, report it to the union.

Minimum services, how do they work?

Minimum services only exist for essential needs in society. It is up to the workers, through their union, to organise these minimum services. The abuse of defining illegal minimum services should be challenged.

Can the boss register who goes on strike?

Yes, but there are no consequences for the worker. No discrimination is allowed for joining a General Strike.

Can I be harmed or suffer retaliation?

No.

If my boss contacts me, what should I do?

First of all, you can choose not to answer because you are on strike; if you do answer, you are not obligated to provide any information. Your absence on that day is covered by the strike, so it only results in the loss of one day's pay.
